Nakea Privacy Policy

Nakea takes your privacy seriously. We will not sell, lease or exchange your personal data to third parties in ways other than described in this privacy policy. This Privacy Policy is a part of the Nakea Acceptable Use Policy. By using Nakea, including services available at the Nakea.net domains, users are using a service provided by Nakea, Inc. and they agree to be bound by the Acceptable Use Policy and this Privacy Policy. This Privacy Policy only addresses activities from our servers.
1. Information Collection & Use
- Registration
The Nakea service requires a login in order to provide you with a personalized account. During our account registration process, we will collect a login name, password, and an email address from you. You must provide all of this information in order to obtain an account. After completing our registration form, you will receive a welcome email describing your new Nakea account, and how to access that account. - Account Subscriptions
If you choose to continue service with Nakea via a paid account, Nakea will collect personally identifiable information (credit card number, billing address, phone number) and keep this information on file in our credit card processors’ secure server in order to process your recurring invoices. This information is only used to verify credit card authenticity, collect payment, and issue invoices as per your service agreement. Upon discontinuation of Nakea service, your information will be immediately destroyed on our billing system.
If we are unable to process your subscription for a given month, this information, along with your account information, may be used to contact you or transferred to a collections agency or other party responsible for debt collection.. - Email Tools
Nakea provides a number of tools that will allow you to promote your website (or articles on your website) over email. Email addresses entered into these forms are not stored in our Nakea’s corporate database, but may be stored in our system logs in text format to assist us in tracking down abusive users (users flooding the system), or using these tools for spamming. We will never contact addresses logged in this manner. The email sent through any of these mechanisms is a one timeone-time email only. - Hosted websites
Users hosting websites with Nakea are given tools that may ask you to optionally enter your email address when making comments on their website, or contacting them through their website. Since users on Nakea can manipulate the HTML code on their site directly, there are opportunities available for a malicious user to inject code that would log your information before it reaches our system. In addition, once in our system, website owners will have the opportunity to review and modify any information entered into their website. Since we do not have full control over how members run their individual sites, this privacy policy does not apply to any hosted Nakea website that you do not own. You should check that you trust the owner of a particular website before submitting personally identifiable information on that site. - Server Logs
When accessing web pages on the Nakea.com domain, Nakea may log your IP address, access URL, time of access, browser type, and referral URL in order to provide us with internal information regarding site traffic statistics. This information may also be used to identify users who are using the service for spam or other activity that is deemed in conflict with our Terms of Service. This information is used in the aggregate, and is never linked back to any personally identifiable information.
2. Uses of Information
Nakea collects the aforementioned personally identifiable information in order to
provide you with a service that allows you to maintain an online presence. Various
features in our website management system will, at your discretion, display your
name, or adjust the date and time of events based on your locale. The Nakea Website
Manager interface will always give you an option before any piece of your personally
identifiable information is presented on your website, and situations where information
will be published is made clear in various spots in the interface (for example,
your name is tied to welcome emails you send out from our system, and notice of
this is given to you within the interface for that tool).
Nakea also uses information collected through its service to send out notifications regarding service related issues (such as maintenance periods, billing problems, account expirations, and other items that may impact service). We do not send contact information unless the matter is deemed urgent, and most communication will occur through your Nakea Website Manager interface.
Information collected through our service logs is used only to identify potential cases of abuse and establish statistical information regarding website traffic. This statistical information is not aggregated in such a way that would identify any particular user of the system.
Nakea, Inc. is the sole owner of information collected on http://www.nakea.net/. Your information is never shared, leased or given to any third parties in ways other than disclosed in this privacy statement.
3. Information Security
We store all user information in secure databases protected via a variety of industry-standard access controls. Secure passwords, SSL encryption, disk-based encryption, firewalls, and other measures are in place that help us protect your data. This data is accessed only for the purposes specified in this privacy statement.
4. Access to Personally Identifiable Information
- Changing Information
All information that Nakea stores related to your account, including any subscription billing information, is accessible through your Nakea Website Manager interface. You may use this interface to adjust your information at any time, and we encourage you to keep this information up to date so that your customer service requests and billing processes operate efficiently. - Removing Information
To remove your personally identifiable information from our system, submit your account for deactivation. Your personal information will be removed immediately, though your actual login name will remain reserved on our system until re-collection. If you wish to only remove your billing subscription information, cancel your paid account. Both of these removals can be accessed through your Nakea Website Manager interface.
5. Communications from Nakea, Inc.
- Announcements of Service-related Issues
We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account. - Customer Service / Support
Upon issuing a customer support request to Nakea, we may use your information and email address to contact you regarding your inquiry.
6. Information Sharing and Disclosure
- Aggregate (non-personally identifiable) Information
We share aggregated demographic information about our user base with our partners. This information does not identify individual users. This information contains statistics related to traffic and the geographic location of our customers.
We do not link aggregate user data with personally identifiable information.
7. Credit Card Processing
We will submit your billing information to our credit card processing agent for approval when you update your billing information, or place an order on our website. This company does not retain, share, store or use personally identifiable information for any purpose other than billing.
8. Choice/Opt-out
Only non-promotional service announcements, as described in the above section, will be issued without prior authorization.
Upon deactivating your Nakea account, you will receive no further communication from us (service announcements included).
9. Log Files
As is true of most websites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.
We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users' movements around the site and to gather demographic information about our user base as a whole.
We do not link this automatically-collected data to personally identifiable information.
10. Cookies
Like most websites, we use small bits of data called cookies stored on users' computers to simulate a continuous connection. Cookies let us 'remember' information about your preferences and passwords and allow you to move within our Service without reintroducing yourself. Members who disable cookies will not be able to use Nakea's services, as they are required to maintain your login to our service within a browser session. Disabling cookies does not prevent you from accessing websites published under our system, though some features of those sites may be degraded.

12. Business Transitions
In the event Nakea, Inc. goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personally identifiable information will likely be among the assets transferred. Nakea offers you a variety of online products and services, including general and personalized content, communication tools and forums, and online and downloadable applications (the 'Service') on the following terms. By using the Service in any way you are agreeing to comply with these terms, which we may update without notice and we encourage you to check here for updates.

1. Acceptable Use
Nakea does not allow any of the following content, or links to such content, to be published on the Service:
1. Content of a pornographic, sexually explicit, or violent nature.
2. Content of an illegal nature (including stolen copyrighted material).
3. Pirated software sites, including cracking programs or cracking program archives.
4. Content with the sole purpose of causing harm or inciting hate, or content that could be reasonably considered as slanderous or libelous.
Users posting any of the above content on their sites will be notified using User's current email address on file, and given a 48 hour grace period to make any corrective actions. If no corrective actions are taken, Nakea will suspend the services of the member account until a resolution is met between Nakea, Inc. and the User. A repeated violation of this Policy may cause cancellation of service without refund of any fees.
In addition, Nakea does not allow any of the following:
5. Users may not use the Service as a remote storage server only.
6. Users may not access the Service through automated methods. Use of robots or other computer code which calls the Service, except where explicitly allowed, is absolutely forbidden.
7. Users must exercise caution when hosting large downloads (>10MB). Nakea reserves the right to refuse to host any large downloadable files.
8. Users may not send unsolicited messages (also known as junk mail or SPAM) to promote any website published on the Service.
Users are not permitted to knowingly allow another website or hosting server to link to content files stored on Nakea's servers. Users deemed to be using Nakea solely as a remote storage server will have their account immediately terminated and will have all files associated with their account permanently removed.
The final choice of whether an account is in violation of any of these policies is at the sole discretion of Nakea, Inc.
Violation of any of these policies may result in tracking information being stored to identify the offending user, and permanent restriction from holding an account on the Service.
2. Material and Products
1. Nakea, Inc. and its Partners provide Services on an "as is" basis.
2. Nakea, Inc. shall make no effort to validate any information provided by the User for use with Services for content, correctness or usability.
3. Use of Nakea, Inc. services requires a certain level of knowledge in the use the Internet and World Wide Web. The User is required to have the necessary knowledge to use the Internet and the World Wide Web.
4. It is not the responsibility of Nakea, Inc. to provide free support for the User in the use and operation of Nakea, Inc.
5. Only services and features clearly indicated as "free" or "no charge" are free or without charge. All other applications, features, functionality and support provided by Nakea, Inc. and its partners are provided for a fee and the User is liable for such fees.
6. The User may not rent or lease or provide the Services (including any software or documentation used by or with the service) to third parties.
7. The User may not decompile, disassemble, reverse engineer, copy, create a derivative work, or display the Software code in human readable form, or otherwise use the Services (which includes its software and documentation) except as explicitly provided for in this agreement.
8. The User may not store, publish, or give the Services (including software and documentation) to others, or otherwise enable its use by others.
9. You agree that you will not use the Services to share, store, or in any way distribute financial data that is not in accordance with the law. Any users suspected of having information which involves fraud, embezzlement, money laundering, insider trading, support for terrorism, or any other activity proscribed by law may have their accounts terminated, their financial data erased, and they also may be reported to law enforcement officials in the appropriate jurisdictions. Nakea is not responsible for the Content or data you submit on the website.
10. Nakea may require you to place all or any portion of the Content behind password protection if Nakea determines that such Content is inappropriate for the community at large but does not otherwise violate the terms of this Agreement. If Nakea has requested you to place Content behind password protection or if you independently determine that the Content appropriately belongs behind password protection, you may not publish the password in such a way that negates the limited-access nature of the password protected site. If Nakea requests you to place any Content behind password protection and you fail to do so promptly, Nakea reserves the right to (a) place such Content behind password protection itself, or (b) terminate this Agreement.
3. Nakea Etiquette and Privacy
1. Electronic forums such as mail distribution lists and news groups all have expectations regarding subject area and appropriate etiquette for posting. Users of these forums should be considerate of the expectations and sensitivities of others on the network when posting material for electronic distribution.
2. The network resources of the Nakea, Inc. may not be used to impersonate another person or misrepresent authorization to act on behalf of others or Nakea, Inc.
3. All messages transmitted via Nakea, Inc. should correctly identify the sender; Users may not alter the attribution of origin in electronic mail messages or posting.
4. All users shall not attempt to undermine the security or integrity of computing systems or networks of Nakea, Inc., its Partners, or those accessed through or with their product, and must not attempt to gain unauthorized access.
5. All user-specific information provided by user in connection with Services shall be governed by the Nakea Privacy Policy (located at http://www.nakea.net/legal/#pp). User understands and accepts all terms and conditions contained within the Nakea Privacy Policy.
6. Nakea reserves the right to terminate any account that does not include a valid email address on file. This email address must be stored in the profile for the administrative account within User's website on the Nakea system.
7. Community forums; The Services may include a community forum to exchange information with other users of the Services and the public. Please use respect when you interact with other users. Nakea does not support and is not responsible for the accuracy of others’ content in these community forums. Do not reveal information in the community forum that you do not want to make public. Users may post hypertext links to content hosted and maintained by third parties for which Nakea is not responsible.
4. Age and Nature of the User
1. The User certifies that he or she is a person at least 18 years of age.
2. The Services may not be used by any automated device or automated computational machine.
3. The Service may only be used or accessed through an electronic device under the manual control of User at all times.
5. Taxes
1. Nakea, Inc. shall not be liable for any taxes or other fees to be paid in accordance with or related to purchases made from or by the User or through the Nakea, Inc. services.
2. The User takes full responsibility for all taxes and fees of any nature associated with Services used or products purchased.
6. Contract Revisions and Applicable Legal Jurisdiction
1. Revisions to this Agreement will be applicable to previous version of this Agreement. Revisions will be considered agreed to by the User continuing to use of or access the Services in any way.
2. Nakea, Inc. reserves all rights for changes and/or modifications to the Services and rates and will communicate these changes to the subscriber within 30 days of their effect.
7. Termination
1. This Service may be terminated by either party, without cause, by giving the other party 3 days written notice.
2. Notwithstanding the above, Nakea, Inc. may terminate Services at any time, without penalty and without notice, if the User fails to comply with any of the terms of this Agreement or the intellectual property protections applicable to these Services. Nakea, Inc. may also seek legal prosecution of any violations of law or this Agreement and the User agrees to personal jurisdiction by the Courts in the State of New York.
3. Upon notice of termination of Services by Nakea, Inc. to User via contact e-mail to User's Services account and contact e-mail account provided in User's personal information, or voluntary termination of service by User, Nakea, Inc. has the right to delete all data, files, or other information that is stored in the User's account for any reason.
